Terms of Use

These Terms of Use (“Terms”) govern your access to and use of nextgenwelder.com (the “Site”), operated by Next Gen Welder LLC (“Next Gen Welder,” “NGW,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Prelaunch website

The Site currently provides information about Next Gen Welder, its community, and products in development. Items labeled “Coming Soon” are not offered for sale, and the Site does not currently process purchases, reservations, or orders. Product concepts, features, availability, and timing may change.

2. Informational content

Site content is provided for general informational purposes only. It is not welding instruction, safety training, engineering advice, or a substitute for applicable standards, workplace procedures, manufacturer instructions, supervision, or professional judgment. Welding and fabrication involve serious hazards; use appropriate training, protective equipment, and safety practices.

3. Acceptable use

You may not misuse the Site, interfere with its operation or security, attempt unauthorized access, introduce malicious code, scrape or copy content through automated means in a manner that burdens the Site, impersonate another person, or use the Site in violation of law or the rights of others.

4. Intellectual property

The Site and its content—including NGW names, logos, branding, text, graphics, layout, and original materials—are owned by or licensed to Next Gen Welder LLC and are protected by applicable intellectual-property laws. You may view the Site for personal, noncommercial use. No other license is granted without our prior written permission.

5. External services and community links

The Site may link to Discord and other third-party services. Those services are operated independently and have their own terms, policies, and community rules. A link does not mean we control or endorse all third-party content, and your use of those services is at your own risk.

6. Disclaimers

To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We do not warrant that the Site will always be uninterrupted, error-free, secure, or current. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

7. Limitation of liability

To the fullest extent permitted by law, Next Gen Welder LLC and its members, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of—or inability to use—the Site. This limitation does not apply where liability cannot legally be limited.

8. Changes and availability

We may modify, suspend, or discontinue any part of the Site and may update these Terms from time to time. Updated Terms become effective when posted with a revised “Last updated” date. Continued use of the Site after an update means you accept the revised Terms.

9. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any mandatory consumer protections that apply to you remain unaffected.
